Terms and Conditions

By creating an account or using the GardenSwap app, you agree to these Terms and Conditions. If you don't agree, please don't use the app.

1. Using GardenSwap

GardenSwap is a marketplace and community that connects local growers and buyers. By using the app, you agree to provide accurate account and listing information and to conduct exchanges and community interactions in good faith.

2. Your Account

You must be at least 13 years old to use GardenSwap. You're responsible for maintaining the security of your account and for all activity that happens under it. Let us know right away if you believe your account has been compromised.

3. Listings

Sellers are solely responsible for their listings, including the accuracy of price, condition, quantity, and availability, and for making sure the item, animal, food product, or service being listed is legal to sell, own, or transfer in their location. This includes, without limitation, compliance with all applicable food safety, agricultural, cottage food, animal sale, and licensing laws. GardenSwap does not inspect, test, license, certify, or guarantee any listing, and does not verify that a seller is legally permitted to sell what they post. All liability connected to a listing, and to any transaction that results from it, belongs solely to the user who posted it.

4. Transactions

GardenSwap is a listing and communication platform only. We do not process payments for listings and are not a party to any transaction. Exchanges arranged through the app, including any in-person meetup, cash payment, or hand-to-hand exchange of goods, happen directly and independently between buyers and sellers. GardenSwap is not responsible for disputes, damages, injury, illness, or losses of any kind arising from a transaction, meetup, or exchange between users, or from the quality, safety, or legality of items exchanged.

5. Ratings and Reviews

Members may leave a star rating and comment on another member's profile. Reviews should reflect your genuine experience. Don't post false, misleading, or abusive reviews. You may edit or delete your own review at any time, and we may remove reviews that violate these terms.

6. Badges and Verification Tags

GardenSwap may display a badge, tag, or label (such as a "Verified" or "GardenSwap Plus" tag) on a profile or listing. Unless explicitly stated otherwise at the time it's shown, a badge or tag reflects only a limited check or a subscription status. It does not mean GardenSwap has confirmed the existence, legality, safety, quality, or accuracy of the person, their listing, or any claim they've made. Do not treat any badge or tag as a guarantee of any kind.

7. Your Content

You're responsible for everything you post or send in GardenSwap, including listings, photos, profile information, forum posts, comments, reviews, and messages.

You keep ownership of the content you post. By posting it, you give GardenSwap a non-exclusive, royalty-free permission to store, display, and share that content within the app, only as needed to operate the service. This permission ends when you delete the content or your account, except for copies another user has already received in a message. You confirm that you have the right to post anything you share.

Content may be automatically screened before it's posted, and content that appears to break these terms may be blocked.

8. Prohibited Content and Conduct

The following are not allowed anywhere in GardenSwap, including in listings, photos, profiles, forum posts, comments, reviews, and messages:

• Sexually explicit or adult content, including nudity, pornography, sexual services, or sexually suggestive material.
• Any content that sexualizes or exploits minors. We have zero tolerance for this and will report it to law enforcement.
• Illegal drugs and controlled substances, including marijuana or cannabis plants, clones, seeds, and products, psychedelic mushrooms or spores, and drug paraphernalia. This applies even where they may be legal locally.
• Alcohol, tobacco, vaping, and nicotine products, and prescription medications.
• Weapons, ammunition, explosives, and fireworks.
• Stolen, counterfeit, or recalled goods.
• Plants, seeds, animals, or products that are illegal to sell or transport where you live, including invasive or noxious species and protected wildlife.
• Any other illegal activity, or offering or arranging anything that is illegal to buy, sell, or exchange.
• Harassment, bullying, threats, hate speech, or content that promotes violence or self-harm.
• Scams, fraud, spam, misleading or fake listings, and impersonating another person or business.
• Attempting to interfere with, disrupt, or gain unauthorized access to the app or its infrastructure.

We may remove content, restrict features, or suspend or permanently terminate accounts that violate these rules, with or without notice. We may also report illegal activity to law enforcement. You can report content or users from the "..." menu in the app, or by emailing support@gardenswap.app.

9. GardenSwap Plus (Subscriptions)

GardenSwap Plus is an auto-renewing subscription offered in weekly, monthly, and yearly plans, purchased and billed through your Apple ID or Google Play account. Payment is charged to that account when you confirm the purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours before the end of the current period at the price you agreed to at purchase. You can manage or cancel your subscription anytime in your device's subscription settings. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

10. Account Deletion

You may permanently delete your account at any time from Account → Delete Account in the app, or by following the instructions at www.gardenswap.app/delete-account.html. This removes your listings, photos, messages, forum posts, ratings, profile, and login, and cannot be undone. Deleting your account does not automatically cancel an active subscription. Cancel it separately through your device's subscription settings.

11. Disclaimer and Limitation of Liability

GardenSwap is provided "as is" without warranties of any kind. To the fullest extent permitted by law, GardenSwap is not liable for any indirect, incidental, or consequential damages arising from your use of the app, any listing, or any transaction with other users.

12. Indemnification

You agree to indemnify and hold GardenSwap harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising from your listings, your content, your compliance (or non-compliance) with applicable laws, or your transactions or interactions with other users.

13. Changes to These Terms

We may update these terms from time to time. Continued use of the app after changes take effect means you accept the updated terms.
